A SAP evaluation isn’t a test you pass or fail. It’s a clinical conversation with an independent professional whose job is to determine what you need to safely return to work. Current DOT regulations allow SAP evaluations to be conducted remotely using real-time audio and video, consistent with 49 CFR § 40.281 as amended by the May 2023 final rule (88 FR 27596). What the SAP can and can’t do

A lot of the anxiety around SAP evaluations comes from not knowing what the SAP is actually going to do. Here’s the short version.

Your SAP will:

  • Conduct an independent clinical evaluation
  • Recommend education or treatment if needed
  • Decide when you have complied with the recommendations
  • Report your compliance status to your employer and the Clearinghouse

Your SAP will not:

  • Work for your employer
  • Decide whether you get rehired
  • Share clinical details of the evaluation with your employer (compliance status is reported separately under DOT rules)

How to prepare

Bring:

  • Employer paperwork related to the violation
  • A list of any medications you are currently taking
  • Any prior treatment records, if you have them

Before the evaluation:

  • Find a private spot with reliable internet
  • You will need a device with a camera and audio. A cell phone, tablet, or computer all work.
  • Plan on roughly 60 to 90 minutes without interruptions
  • Be ready to talk openly about what happened

What happens during and after the evaluation

Your SAP will go over your history, talk through the violation, conduct a clinical assessment, and write up a recommendation. The initial evaluation function is described in 49 CFR § 40.293, and the report requirements are in § 40.311.

What is required to begin the process

  • Pre-Assessment Questionnaire: $95. Required by your SAP to begin the process.
  • SAP Evaluation + Follow-Up: up to $500 maximum. Paid directly to your SAP. Includes both required evaluations.

Any education or treatment recommended by your SAP is provided by independent program providers and billed separately by those providers. Program costs and timelines vary.

How long does a SAP evaluation take?

Initial evaluations generally run around 60 to 90 minutes, though actual length depends on the situation. The follow-up evaluation, scheduled after you complete any recommended education or treatment, is usually shorter.

Is the SAP evaluation confidential?

Yes. SAPs operate under the confidentiality and reporting rules described in 49 CFR Part 40. Your compliance status is reported to your employer and to the Clearinghouse where applicable. The clinical content of the evaluation itself is handled under those rules. Your SAP can walk you through what is and is not reported in your specific case.

What if I disagree with my SAP’s recommendation?

The SAP’s clinical determination is binding for the Return-to-Duty process. If you have concerns, talk to the SAP about them directly during the evaluation. You cannot shop for a different recommendation by starting over with a new SAP after one has already issued a determination.

Can the evaluation really be done virtually?

Yes. Under 49 CFR § 40.281, as amended in May 2023, SAPs can conduct evaluations using real-time audio and video. The clinical process and the documentation requirements are the same as an in-person evaluation.
