Who Needs a DOT SAP Evaluation in New Mexico?

You need a DOT SAP evaluation if you are in a safety-sensitive position covered by federal DOT regulations and you tested positive on a drug or alcohol test, refused a test, or otherwise violated the testing rules. The Return-to-Duty process is a federal requirement under 49 CFR Part 40, and you cannot return to safety-sensitive work until you have completed the SAP evaluation and follow-up.

In New Mexico, DOT-regulated professionals include CDL drivers hauling freight along I-40, I-25, and US-70 (regulated by the Federal Motor Carrier Safety Administration), pilots and safety personnel at Albuquerque International Sunport and other New Mexico airports (Federal Aviation Administration), rail workers on BNSF and Union Pacific lines through the state (Federal Railroad Administration), transit workers on ABQ Ride and other systems (Federal Transit Administration), and pipeline operators serving Permian Basin infrastructure (Pipeline and Hazardous Materials Safety Administration).

How the New Mexico DOT SAP Return-to-Duty Process Works

1. Complete the Pre-Assessment Questionnaire

   Complete the $95 online Pre-Assessment Questionnaire and select a New Mexico SAP from the FindASAP directory.

2. Virtual Initial Evaluation

   Attend a virtual initial evaluation with your SAP, typically scheduled within one week of payment.

3. Receive Your SAP's Recommendation

   Your SAP determines the education, treatment, or combination of both that fits your specific situation.

4. Complete Education or Treatment

   Complete the recommended education or treatment on your own timeline.

5. Follow-Up Evaluation & Return-to-Duty

   Attend a virtual follow-up evaluation. Your SAP issues a Return-to-Duty recommendation to your employer's Designated Employer Representative.

From start to finish, most New Mexico drivers complete the process in two to six weeks. Only after your employer receives the SAP's Return-to-Duty recommendation and you pass a Return-to-Duty drug test can you resume your safety-sensitive duties. The SAP does not authorize your return to work; your employer does, based on the SAP's recommendation.

New Mexico DOT SAP Evaluation Cost

The FindASAP portion of the New Mexico DOT Return-to-Duty process has two components:

• $95 Pre-Assessment Questionnaire.
• Up to $500 paid directly to your SAP for the initial and follow-up evaluations.
• Total for the SAP portion: up to $595.

Any education or treatment your SAP recommends is billed separately by the provider who delivers that service. Costs vary widely, from free peer support meetings to structured outpatient treatment programs. Your SAP will discuss expected cost ranges during your initial evaluation and can refer you to New Mexico–based providers if you prefer local treatment options.
